If you are in the United States and had an Aeries Software, Inc. account through the San Dieguito Union High School District at the time of a data breach which occurred beginning on or about November 4, 2019, you may be eligible for benefits from a class action settlement.

  • A proposed Settlement has been reached in a class action lawsuit called Anurag Gupta and by and through him, D.G. and V.G., his minor children, et al. v. Aeries Software, Inc., Case No. 8:20-cv-00995-FMO-ADS (C.D. Cal.) (the “Settlement”).

  • The lawsuit relates to a data breach that took place beginning on or about November 4, 2019, affecting certain personal information of individuals with Aeries Software, Inc. (“Aeries”) accounts through the San Dieguito Union High School District relating to the Aeries School Information System utilized to manage student data (the “Data Breach”). 

  • Aeries denies all allegations of wrongdoing or liability made in the lawsuit. 

  • The Court has not decided who is right or wrong. Instead, both sides have agreed to the Settlement to avoid the cost of further litigation.

  • You are Settlement Class Member if you had an Aeries account at the time of the Data Breach which occurred beginning on or about November 4, 2019.

  • The proposed Settlement provides for a fund totaling $1.75 million. The Settlement Fund will be used to pay for the following: (1) all Notice and Administration Expenses; (2) any award of Attorneys’ Fees and Expenses approved by the Court; (3) any Service Award to the Settlement Class Representative; (4) Approved Claims for Out-of-Pocket Losses; (5) Approved Claims for Attested Time; and (6) Additional Cash Payments. The proposed Settlement also includes Credit Monitoring Services and Equitable Relief that will be paid by Aeries separate and apart from the Settlement Fund.

  • Settlement Class Members’ rights and options—and the deadlines to exercise them—are explained in the Notice. The deadlines may be moved, canceled, or otherwise modified, so please check this website regularly for updates and further details.

  • Payments will be made if the Court approves the Settlement and after any appeals are resolved. Please be patient.
